www.RealNest.in, (hereafter referred to in the document as "RealNest") is owned, hosted, and operated by RealNest, a company incorporated in India under the Companies Act, 2013 and having its registered office at 185, Lingavel Towers, Velachery, Chennai - 600042
Any individual, legal entity, or group of personnel who have subscribed to the services rendered by RealNest will henceforth be referred to as authorized users. Any authorized user will have a valid user ID and password, and their access to the site will be restricted. The choice of the user ID will be agreed upon mutually between RealNest and the authorized user. Only an authorized user has the right to access services rendered by RealNest
Based on the above definition, it is made abundantly clear that any person (termed as an unauthorized users), apart from an authorized user, who accesses the services rendered by RealNest does not have any legal right to do so and consequently will be subject to the terms and conditions governing the use of RealNest. Any such unauthorized user accessing the services will be subject to expressly respecting the intellectual property rights of RealNest and also abiding by the terms and conditions.
'User' and 'customer' will be used to denote both the authorized and the unauthorized user(s).Services' or 'Services' are defined as follows: Includes all the dynamic and interactive online services offered by RealNest. These services (s) enable a user to gain entry and provide access to the information and database maintained by RealNest. These terms will also comprise, but will not be restricted to, all the features of the online interactive services used by a user, like search engine tools, matching software, etc. The term service(s) excludes the circumstance where RealNest. Acts on behalf of a customer/user or an agent representing other people/organizations.
Any property listed should be free from encumbrances, and all details regarding the encumbrances should be divulged. The customer should furnish all details sought by RealNest, and if need be, provide proofs, legal documents, and affidavits thereof to support the details. RealNest holds the rights, without any obligation, to search and remove any property listing if any breach in the status of the property is found. A customer agrees to this, and RealNest holds the rights to terminate or refuse service to a customer who violates this agreement, intentionally or otherwise. RealNest reserves the sole right to decide upon how a property will be listed, searched, or downloaded. Copied, displayed, and/or otherwise used and features in RealNest. RealNest also holds the express rights to modify the way the property is featured.

When you virtually visit RealNest, correspond with us over email, or respond to advertisements on the site, you are communicating with us electronically. This consequently gives your consent to receive electronic communications from us. We will communicate with you by e-mail or by posting information notices on this site. You agree that all agreements, notices, disclosures, and other communications that we provide you through electronic communications satisfy any legal requirement that such communications be in writing.
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. Furthermore, you hereby agree to accept complete responsibility for all activities that occur under your account or password. Mode: By registering your profile on RealNest, you choose to become a member of RealNest. However, membership is neither automatic nor guaranteed by mere registration. The right of admission vests solely with RealNest. You will become a member only when your profile is duly accepted by RealNest. Membership and rights of admission to RealNest and their services are reserved solely for the following categories of people: Indian Nationals & Citizens, Persons of Indian Origin (PIO), Non-Resident Indians (NRI), and Persons of Indian Descent or Indian Heritage.
Length of Membership: You will continue to be regarded as a member of RealNest until RealNest discharges its obligations to you by the rendering of its services, or there is a termination of the membership by either RealNest or you.
Privacy of Membership: Your Membership is only for personal use. It is not to be assigned, transferred, or licensed to be used by any other person/entity. Our site does not vouch for or subscribe to the claims and representations made by advertisers regarding particulars of property and real estate transactions.
You are responsible for the content and information [including profile and photographs] you post or transmit through the services of RealNest You will not post or transmit any content or information [in whatever form they may be contained] that is defamatory, blasphemous, abusive, obscene, sexually oriented, profane, intimidating, illegal or in violation of the rights of any person, including intellectual property rights. No content or information shall contain details or particulars of any of the competitors of RealNest, including their contact details. You will not use either your online or offline membership as a platform for any kind of promotional campaign, solicitation, advertising, or dealing in any products or services, or transmit any chain letters or junk mail.
RealNest reserves the right to modify your content if any prohibitive or objectionable content is found, or in the case of your contact details being entered in irrelevant fields. RealNest may also modify the profile for other reasons not mentioned herewith. RealNest reserves the right but is not obligated to edit, delete, eclipse, or withhold the display of such content or information as it deems fit in the light of the rules prescribed above.
RealNest does not collect or store any credit card details in a location that can be accessed through the Internet. RealNest takes maximum security and precaution to ensure that once a transaction is completed, the credit card data is shifted offline. RealNest takes adequate security measures to protect and ensure that any/all information related to the electronic transfer of money is safeguarded and does not reach the wrong hands. RealNest will not be liable for any loss or damage incurred by a customer due to the disclosure of any information related to the customer's account or online transactions. Furthermore, RealNest is not liable for any loss or damage sustained by a customer during their disclosure of information for any verification processes or for any error, omission, or inaccuracy concerning any information so disclosed and used, whether or not in pursuance of a legal process or otherwise.
The payment reconciliation team at RealNest works 24/7; however, there is no guarantee on the accuracy or timeliness with regard to the refunds of failed transactions reaching the customer's bank or credit account, as this is dependent on the various organizations involved in the process of a refund. Refunds for incorrect or objectionable property content being featured on the website will be done and approved based on the sole discretion of RealNest. If a customer uses RealNest without accordance with the Terms and Conditions, RealNest reserves the sole right to block, terminate their access, and/or seek additional relief to compensate for their actions.
All content on this website is provided "as is" and without warranties of any kind, either express or implied, other than those warranties which, under the Indian Laws applicable to these terms, are implied by law and are incapable of exclusion, restriction, or modification. RealNest disclaims any warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Provision of Service: Any approved member of RealNest will be eligible for all the services opted for by them. They will also be allowed to avail themselves of all the free services available on the site.
Medium of Interchange of Information: Apart from providing services, RealNest is a platform for members to exchange information. It is underlined here that RealNest will merely provide contact between and among the members of the platform and does not act as an agent for anyone. RealNest does not share or partake in the exchange between members or the consequent results thereof. In the event of disputes between the parties, RealNest will be an unrelated and disinterested third party. If feasible, RealNest will enable an amicable resolution of the disputes.
Right to form Consortium/Associates: RealNest reserves the right to outsource some or all aspects of the provisioning of services to any competent person or third parties without notifying the members. However, a member's responsibilities and rights remain vested towards RealNest only and not the person or the third party.
Invitation: Members hereby express agreement and solicit and invite RealNest or its authorized personnel to connect and communicate with them through any/all telecom means in the registered number provided in order to explain and clarify the details of the registered and available services. Furthermore, the same can be done in order to assist, aid, or provide support for the registered services.
If at any time, a member wishes to discontinue receiving the communications (including, but not limited to emails, sms, and phone calls) from RealNest they may do so by email to support@realnest.in to indicate the same to RealNest and/or its authorized personnel regarding such discontinuance and the member hereby agrees that, unless expressly communicated by them about discontinuing communications from RealNest and/or its authorized personnel, it will be deemed to be that the member wants to continue and solicit and invite all such or other communications from RealNest.
Confidentiality: RealNest will maintain confidential all personal information other than that meant for posting or transmission furnished by members. However, RealNest may divulge such information if required by law.
By sending a membership request, agreeing to register at RealNest or responding to and advertising on RealNest or by using the services of RealNest, the user hereby acknowledges and allows RealNest to get in touch with him/her from time to time to inform them users on events or properties for sale. This could include, but is not limited to, new and exciting offers, information, as well as promotions. RealNest will be allowed to use the user's email address and or contact numbers for this purpose, irrespective of the user's registration with the "National Do Not Call Registry" and will overrule any such registrations. The user agrees to the aforementioned conditions and cannot hold RealNest responsible for not complying with NDNC. In the event of theft or/loss of user identification/or password/or security word, the User shall notify the Company immediately by telephone/or personally concurrently provide the Company with a written notice to that effect. The User shall remain liable for use of the Services by any third party until such theft or loss is notified to the Company.
Termination of Membership: Either party may terminate the membership by communicating through acceptable physical or electronic means, like serving a written notice to the other. RealNest reserves the right to terminate the membership, to suspend a profile, or to disable access in respect of any member in breach of any of the terms. In no case will the Membership fees be refundable.
Refund of Fee: The Membership Fees ARE NOT REFUNDABLE under any circumstances. You may not authorize others to use your membership, and you may not assign or transfer your account to any other person or entity.
Indemnity: You hereby agree to indemnify, defend and hold harmless RealNest and/or its affiliates, their websites and their respective lawful successors and assigns from and against any losses, liabilities, claims, damages, costs and expenses (including reasonable legal fees and disbursements in connection therewith and interest chargeable thereon) asserted against or incurred by RealNest and/or its affiliates, partner websites and their respective lawful successors and assigns that arise out of, result from, or may be payable by, any breach or non-performance of any representation, warranty, covenant or agreement made or obligation to be performed by You under this agreement.
The sole and exclusive liability for any breach of any country-specific rules and regulations or general code of conduct lies with you as a member, and RealNest cannot be held responsible for the same site Policies, Modifications, and Severability.

We reserve the right to make changes in our site, our policies, and these Terms and Conditions of Use at any time. The membership is deemed to have been entered into in Chennai, India, and the laws of India will govern the membership. Disputes arising out of or in any way affecting the membership, including interpretation of any of the terms, are subject to the courts of the appropriate jurisdiction in Chennai. You hereby explicitly agree to the Chennai court's jurisdiction for any disputes that may arise.
